On July 26th, 2011, the Administrative board of Luhansk regional territorial office of the Antimonopoly Committee of Ukraine satisfied the claim of «Slavutich», Carlsberg Group brewing company against the Lisichansky brewery for violating the law on unfair competition.
PSC PBC "Slavutich" claimed on May 14, 2011, for the fact of using the "Slavutich" 500 ml bottles by the Lisichansk brewery. The bottle sample was patented by the company in 2001 and was produced on its order by JSC "Vetropak Gostomel Steklozavod" and other business entities.
During the investigation, it was found that the Lisichansk brewery bought up the empty "Slavutich" 500 ml bottles and then illegally used it for bottling its products, thereby violating the exclusive right of PAO PBC "Slavutich" to use the bottle sample.
As the inquiry progressed, the accused party recognized the existing violations and took some appropriate measures for their elimination. The office of the Antimonopoly Committee of Ukraine recognized by its decision the actions of the Lisichansk brewery as the violation of the law on unfair competition, and imposed a penalty on the enterprise.
In addition, "Slavutich" Carlsberg Group is considering the possibility of reference to the court with the demand to compensate for the damages, if after July 26 the Lisichansk brewery will release beer in the "Slavutich" 500 ml bottle. In this case, the AMCU has the right to impose immediately the penalty on the violator up to 10% of its annual income.
